WEBSITE TERMS AND CONDITIONS

Please take the time to read these terms and conditions. By using Our Website and the Services and information offered on Our Website, you are agreeing to these terms and conditions.

Definitions

Services means online dog training classes and courses, tele-conferencing consults and video conferencing consults

the Website means the website www.jaricastle.com.au

We / Us etc means Jari Castle Dog Training and any subsidiaries, affiliates, employees, officers, agents or assigns.

You must be at least 18 years of age to register or enrol for any of our Services.

You (herein after referred to as “the Client”) have voluntarily employed Jari Castle Dog Training (herein after referred to as “the Trainer”) to assist you in the training of your dog(s). This agreement will be effective as of the date and time you register or enrol and services are booked or purchased.

Description of Services

You understand that the Services offered to you and your pet impart contemporary animal behaviour knowledge, and that training and behaviour modification programs depend on the pet and owner learning new skills. Behaviour is not static; and animals will not continue to perform even trained behaviours without ongoing practice. In cases involving any type of aggression, although behaviour may be modified, the dog is never considered “cured”. An animal’s behaviour is ultimately the owner’s responsibility. The Trainer will make every reasonable effort to help the Client attain their training and behaviour goals with their pet, however the Trainer makes no guarantees of the performance of the Client or pet as a result of providing professional animal behaviour consultation.

Special Needs and/or Circumstances

Please let us know if there are special needs and/or circumstances that are causing difficulties or hardships with your training.

The Client assumes full financial and legal responsibility for the actions of their dog(s).

The Client acknowledges that obedience training and behaviour modification is an activity that carries inherent risk. While reasonable preventative measures will be taken by the Trainer, the Client acknowledges that there may be an activity in which damage or injury to dog(s) and/or persons may occur. Although we have public liability and accident insurance this does NOT include any injury or damage that your dog might do to any other dog, any other person or their property. All veterinary and/or medical costs associated with a dog attack are the responsibility of the owner of the dog that injured another dog or person.

The Client agrees that you, your heirs, assignee and legal representatives will not make a claim against, sue, or attack the property of the Trainer, their family, acquaintances or any other person acting on their behalf (herein after referred to as “their agents”), for injury or damage done to or by dog(s) resulting from actions or inaction, however caused, by the Trainer or their agents. The Client forever releases the Trainer and/or their agents from any and all liability and demands which the Clients and your heirs, assignees and legal representatives may have or may hereafter have for injury or damage to or by dog(s), and assume all risks thereof.

The Client and the Trainer hereby agree to mediate and/or arbitrate any misunderstanding that may arise pursuant to the terms contained herein. In any action or proceeding arising out of this agreement, the prevailing party shall be entitled to reimbursement of costs and legal fees.

This contract for training services supersedes all other agreements, written or oral, previously made between Client and consultant.
